Selectmen Approve Hiring of Additional Legal Counsel
Wayland and the Wastewater Management District Commission have been ordered to pay $1.2 million to the Wayland Town Center developer.
The Wayland Board of Selectmen Tuesday evening agreed to bring on additional legal counsel in the matter of Twenty Wayland v. the Town of Wayland the Wayland Wastewater Management District Commission, according to video posted by WayCam.
In early June, a jury ordered Wayland and the town's Wastewater Management District Commission to pay $990,000 in damages to Twenty Wayland, the developer of Wayland Town Center. The decision stemmed from a lawsuit Twenty Wayland filed in November 2011 accusing the town and the WWMDC of breaching contract by failing to provide 45,000 gallons per day (gpd) of wastewater treatment capacity to the Town Center developer.
An additional ruling by a judge subsequently upped the settlement to about $1.2 million.
Post-trial litigation is ongoing, and selectmen Tuesday night authorized Town Administrator Fred Turkington to hire Mirick, O'Connell, DeMallie & Lougee, LLP to provide special counsel.
Up until this point, Wayland Town Counsel Mark Lanza has provide sole representation for the town in this case.
